iVote Web Security and Privacy Policy

INTRODUCTION

This website and the various content, features and services offered on this website (collectively, the "Site" "iVote" "us" "we" or "our"). The Site provides access to iVote a non-partisan website/application with respondents completing surveys about social and current affairs, covering topics such as the presidential elections, Issues, topics, advertising, consumer goods. Responders will receive information from participating organizations, providers of products or services, and then receive additional promotional materials for and other information about those products and services from those providers (the "Service"). Such providers that are participating in the Service may be referred to as "Providers". When responders register, we ask them a few basic questions, such as verifying demographic information, such as regional location, non-minor status, and age. You should read this notice in conjunction with the Terms and Conditions for this website/application which can be found on the iVote website/application.

1. SCOPE

  1. This website is operated by Commission Champ Advertising, Inc.
  2. iVote complies with data protection legislation such as the Data Protection Act 1998. This regulates the processing of personal data relating to you and grants you various rights in respect of your personal data.
  3. The aim of this statement is to tell you how we will use any data, including personal data, you provide through this website. Please read it carefully before you proceed.

2. COLLECTION AND RETENTION OF DATA

iVote collects the following data from users of this website/application:

1. PROFILE DATA

This is information that you provide when you register and create a profile with iVote. It includes your user ID; a contact email address and other information that you provide during the profile set-up process. Please keep in mind that the goal of the Service is to create an online interactive polling platform offering contests and sweepstakes, access to a collection of polling resources, including various communication tools, forums, services, personalized content, which may be accessed through a marketplace where you can enter contests and sweepstakes for interacting with Providers of goods and services in which you are interested and from whom you may receive promotional information for and other information about those goods and services. The Service offers quality-polling entertainment that will reward you within the iVote Network to find service providers that match your interests. In order to do this, we will need to collect certain information from or about you and share that information with Providers. Providers may require additional information from or about you as well. Depending on the type of products or services in which you are interested, this information may include certain financial information. Thus, while we respect your privacy, the very nature of the Service involves our collection of personal information, disclosure of that information to third parties and communications to you from us and/or third parties. If we collect your name or other Personal Information from you (whether online or offline), and if you have given us permission to share your Personal Information by agreeing to this Privacy Policy, we may occasionally make that Personal Information available to our parent company or other affiliated entities or to third party businesses for their direct marketing purposes so that they can let you know about products or services that may be of interest to you. The Site may include information, services or other features in addition to the Service, such as the ability to participate in special promotions, contests, sweepstakes or other promotions, create an account, complete optional surveys (which we may make available to you on the Site or by e-mail) or send questions or comments to us via e-mail. We may ask you to provide certain Personal Information to access such features. We may sometimes receive information about you from our service providers, political organizations, non-profit organizations, or other business partners, outside websites or other third parties. For example, as part of our standard process of verifying that the information you provide to us is accurate and that your request for information from Providers is legitimate, we may receive additional information about you from a third-party data compilation agency. We may supplement or compare information that you provide to us on the Site with such information from third parties. Our use of such information from third parties in combination with information that we collect from you on the Site will comply with the terms of this Privacy Policy.

Your California Privacy Rights

The following only applies to California residents who have an established business relationship with iVote.

In addition, for non-California residents, if you have given us permission to share your Personal Information by clicking on the appropriate box or button on the Site, we may occasionally make that Personal Information available to our parent company or other affiliated entities or to third party businesses for their direct marketing purposes, so that they can let you know about products or services that may be of interest to you.

2. CONFIGURATION DATA

If you have enabled cookies setting on your browser, then iVote will collect information relating to the navigation within our network. This information will be used to run iVote tracking system and transmitted back to advertisers, partners and data aggregators. This information is used to identify which issues and products are relevant to you and to profile the community so that we can focus development and marketing efforts on common ad server configurations. This configuration data includes:

The version and basic configuration options of the ad server; and

Type and version information about other software which iVote application depends on, including: the web server, PHP and MySQL .NET.

Browser type, geography, connection type, operating system and other information regarding your computer.

3. COMMUNITY INTELLIGENCE DATA

The iVote community is made up of websites, applications, advertisers, sponsors, and partners who use the iVote software to create, promote, manage and deliver online content, and ad campaigns ("iVote").

If you have enabled your 'User Account' in the iVote software, then iVote also collects information relating to your use of the iVote software to create and maintain your ad serving history (" Community Intelligence Data "). This Community Intelligence Data includes:

  1. If you are a user - statistical information about your personal ad serving and the ad campaigns that you have seen; and
  2. If you are an advertiser - statistical information about the ad campaigns that you deliver.
  3. If you are a affiliate- statistical information about your referrals ad serving and the ad campaigns that you run and viewed by your referral.

This information combines total users' Community Intelligence Data to publish aggregate statistical information about the iVote Community so for example, as a service, we may share aggregate Community Intelligence Data with the iVote Community to let them know how many ads are served in the community and which ads were used by iVote users.

4. WEBSITE DATA

iVote collects data regarding anonymous visitors to the iVote website/application including the following:

  1. The IP address of the user's computer (which may include a domain name);
  2. The referring URL (if any); and
  3. Details of the Internet browser software used by the user to view the iVote website/application (s).

Further, if you use the online "User Account" feature of the website/application, we collect your name, address, city, postal code, country, phone number, email , Date of Birth, and other self reported information.

3. HOW WE USE YOUR PERSONAL INFORMATION AND WITH WHOM WE SHARE YOUR INFORMATION

We use your personal information to manage your online profile, send you details of updates and other general communications. If you have indicated that you wish to receive such information, then we may also send you information about new products and/or services that iVote provides. You can opt-out of receiving future marketing material by changing the relevant setting in your iVote profile or by contacting us via support@ivote.com.

We will employ the services of third parties to help us in certain areas, Users, Affiliates, Sponsors, Advertisers, and Partners, such as website hosting, third party marketing, software, services and third party resellers. In these cases, the third party will receive your information, for which you must provide your consent by clicking the consent box after you have read this Privacy Policy.

Once you submit the initial Personal Information and any other information that we require for use of the Service, we may retain and use that information for several purposes related to the Service, including:

  1. We may use such information in order to verify that such information is accurate and that your request for information from Providers is legitimate.
  2. We may use the e-mail address that you provide to send a transactional e-mail to you, reconfirming for you those matching Providers who may be contacting you with promotional material, information or other services (by phone, e-mail or other communication). We may also use the e-mail address that you provide to send a follow-up customer experience survey to ensure the Service meets your expectations and that Providers respond to you in the manner in which you expect.
  3. We may e-mail or call you: (i) to clarify any questions; (ii) to obtain additional information relating to your request and the products or services for which you requested to receive promotional materials from Providers; and/or (iii) to advise you of additional products or services for which you may be interested in receiving promotional materials. Please note that the number or relevance of promotional materials that you receive from Providers may be affected if you do not consent to our contacting you to obtain such additional information. Any information that we collect from you by such means will be treated as though we had collected it on the Site.
  4. If you consent (by checking the appropriate box when filling out a registration form or subscribing at the Site) to receiving communications from us by e-mail or regular mail, such as updates, special promotions or other information related to the Site or the Service or special promotional materials from our promotional partners, we may send you such communications periodically. If you subsequently wish to opt out of receiving e-mails from us at any time, simply follow the instructions for doing so included in the e-mails. We reserve the right to send you certain communications relating to the Site or Service, such as service announcements or administrative or transactional messages, without offering you the opportunity to opt-in to or opt-out of receiving them.
  5. In order to submit your initial information to the iVote Network and use the Service, you will need to consent (by checking a box on the signup form) to being contacted by the iVote Network, Affiliate, Advertiser, or Partner and by those matching Providers who may contact you in connection with your request to receive promotional materials, as further described in this Privacy Policy. Please note that by providing this consent, you may be contacted by telephone by the iVote Network and such Providers notwithstanding any previous request you may have made to be placed on any national, state/province, country or company-specific do-not-call lists.
  6. We may use your Personal Information in order to fulfill or respond to any additional services or information that you may request, such as creating an account for you, responding to your questions or entering you into a sweepstakes or contests. We may also use Personal Information to ensure compliance with our policies and applicable law.
  7. Once you have confirmed that you wish to receive promotional materials from Providers who provide the type of products or services you have identified in your request, eligible Providers will then compete for the right to submit promotional materials to you, as further described in our Terms of Service. We will share the Personal Information and other information that we have collected from you with some or all of these competing Providers, as further set forth in our Terms of Service. The number of Providers with whom you will be matched (that is, the number with whom we will share your information) will be determined by the Service and disclosed to you on the Site where you will be submitting your Personal Information. However, the number of Providers with whom you will be matched will be at least two whenever possible.
  8. After these matched Providers receive your information from us, they may contact you directly via phone, e-mail or other communication to obtain additional information related to your request, to submit their promotional materials related to your request and/or to perform any customary follow-up services. They may also use such information to obtain any additional information about you from third parties that they deem necessary in determining the terms of their promotion or whether or not to make an offer. We will endeavor to ensure that such Providers do not use the Personal Information about you that they obtain from us for any other purposes. However, we cannot make any guarantees regarding Providers' use of such information and cannot be held responsible if they do use such information for such other purposes. In addition, any Provider whose promotion you accept or with whom you otherwise enter into a transaction shall be free to keep, use and share your information that such Provider obtains from us as though such Provider had collected such information directly from you. We have no control over, or responsibility for, the use of any information that you may provide directly to a Provider, or any information that a Provider obtains from third-party sources, and any such information will not be subject to the terms of this Privacy Policy. Any such information will be subject to the privacy policies of such Provider, and we encourage you to review the privacy policies of Providers before providing any information to them.
  9. In certain circumstances, a Provider with whom we share your information may actually be a broker, representative, or organization supporter rather than a direct provider or representative of the organization, products or services that you would like to receive. In such a case, we will grant the broker or representative permission to share the information about you that we provide to the broker or representative with one direct provider or representative of such organizations, products or services. Such direct provider or representative will then be considered the actual Provider for purposes of this Privacy Policy and may use your information and contact you as set forth herein. We will endeavor to ensure that the broker or representative will not use your information for any other purposes, and we will not grant the broker or representative permission to contact you directly. However, we cannot make any guarantees regarding a broker or representative’s use of such information and cannot be held responsible if the broker or representative does use such information for such other purposes.
  10. You may come to the Site from an online banner ad, link or similar source located on a third-party website. The owner or operator of that website will not have access to the Personal Information that you submit to iVote on the Site (unless, only as permitted under this Privacy Policy, iVote shares such information with such party).
  11. We may sometimes use other businesses to perform certain services for us, such as providing full-service management of Provider accounts, managing our online advertising campaigns, performing data verification and other data processing, facilitating transactional e-mail distribution, maintaining the Site and our mailing lists, sending postal mail (if necessary) and providing marketing assistance and data analysis. We may provide Personal Information to those businesses when that information is necessary for them to complete a requested transaction or otherwise perform their duties. Third party service providers are contractually obligated to protect Personal Information on iVote Network's behalf. As the iVote Network develops, we may buy other businesses or their assets or sell our business assets. Customer information is generally one of the business assets involved in such transactions. Thus, in the event that the iVote Network or all of its assets are acquired, customer information would be one of the transferred assets.
  12. We reserve the right to disclose visitor information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other visitors, Providers, our partner websites or anyone else that could be harmed by such activities. We also reserve the right to disclose visitor information when we believe in good faith that the law requires it.

4. TRANSFER OF YOUR INFORMATION OUTSIDE THE COUNTRY

The hosted version of the iVote Network software platform is hosted by a third parties located in the United States of America, Costa Rica, Europe, and Canada. If iVote provides you with the hosted access, we may transfer some of your information to this third party and all parties that are subscribe to that regional community. By submitting your information to this website in order to receive the hosted version and by ticking the consent box after having read this Privacy Policy, you consent to such transfers taking place.

5. A SPECIAL NOTE ABOUT CHILDREN

Children are not eligible to use our web site and services and we ask that minors (under the age of 18) do not submit any personal information to us.

6. EARNINGS

Your earnings are kept confidential. It is your responsibility to report any winnings to the appropriate authorities. We do not use your information for purposes other than those for which it was originally intended.

7. RETENTION

Your personal information will not be stored for any longer period than is necessary for the purposes for which it was collected.

8. AGGREGATE INFORMATION

From time to time, we may collect general, non-personal, statistical information about the use of the Site and the Service, such as how many visitors visit the Site, how they get to the Site, how long they stay there and which hyperlinks, if any, they "click" on. We collect this information through the use of "cookies" and other tracking technologies, which are discussed in greater detail below. We collect this information in order to determine which areas of the Site are most popular and to enhance the Site and the Service for visitors. We may group this information into aggregate visitor data in order to describe the use of the Site and the Service to our existing or potential business partners, advertisers, Providers or other third parties, or in response to a government request. We may also group Additional Information that we collect from visitors into aggregate data for the same purposes. However, please be assured that this aggregate data will in no way personally identify you or any other visitors to the Site.

9. COOKIES

A cookie is a text-only string of information that a website transfers to the cookie file of your computer’s hard disk. A cookie will typically contain the name of the domain from which the cookie has come, the "lifetime" of the cookie, and a value, usually a randomly generated unique number.

When you visit our website we send you a cookie. We use cookies to identify you as a valid iVote Network user, to ensure that no one else can simultaneously log in and use your iVote Network profile and to help you personalizes your iVote Network experience in conjunction with your iVote Network profile.

However, if you choose to disable cookies, you will not be able to enjoy a significant portion of the iVote Network website/application (s) and software platform functionality.

10. IP ADDRESSES

Your computer uses IP addresses every time you are connected to the Internet. Your IP address is a number that is used by computers on the network to identify your computer. IP addresses are automatically collected by our web server as part of demographic and profile data known as “traffic data” so that data (such as the Web pages you request) can be sent to you.

11. LINKS

Our site contains links to other web sites over which we have no control. We are not responsible for privacy policies or practices of other websites to which you choose to link from this site. We encourage you to review the privacy policies of those other web sites so that you can understand how they collect, use and share your information.

12. SECURITY

We intend to take reasonable and appropriate steps to protect the Personal Information that you share with us from unauthorized access or disclosure. When you transmit Personal Information from your PC to our servers, your information is protected by both a "firewall" (a combination of computer hardware and software that helps keep unauthorized visitors from accessing information within our computer network) and industry standard SSL (secure socket layer) encryption. Unfortunately, no data transmission over the Internet can be guaranteed to be 100 percent secure. As a result, while we strive to protect your Personal Information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your Personal Information.

13. SALE OF THE BUSINESS

In the event that the business is sold or integrated with another business, your details will be disclosed to our advisers and any prospective purchaser’s adviser and will be passed to the new owners of the business.

14. YOUR RIGHT TO ACCESS INFORMATION

You are entitled to see the information held about you. If you wish to do this, please contact us via our online contact form. We may require you to provide verification of your identity and to pay an administration fee (which is currently $25 CAN) to provide a copy of the information we hold. We will respond to any request in accordance with the current data protection legislation and in any event within 40 days of receipt a valid request. Please note that in certain circumstances we may withhold access to your information where we have the right to do so under current data protection legislation.

15. UPDATING YOUR INFORMATION

You may review, correct, update or change your personal information at any time by changing the relevant setting in your iVote Network profile or by contacting support@ivote.com.

16. CHANGES TO THIS PRIVACY POLICY

The terms of this Privacy Policy may change from time to time. We will notify you of any material changes to this Privacy Policy by posting a notice on the homepage of the Site for a reasonable period of time after such changes are made that this Privacy Policy has been updated, and by changing the "Last Modified" date at the top of this Privacy Policy. We encourage you to check this page periodically for any changes. Your continued use of the Site following the posting of changes to these terms will mean you accept those changes.

17. GOVERNING LAW

This Privacy Policy and the privacy practices of iVote Network will be subject exclusively to the laws of the country of Canada, Province of British Columbia. iVote Network makes no representation that this Privacy Policy and such practices comply with the laws of any other country. Visitors who use the Site or the Service and reside outside the Canada do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If you reside outside of Canada, by using our Site or the Service, you consent to the transfer and use of your information outside your country.
